<p>Thanks for using Cốc Cốc browser. Known as the name “Cờ Rôm +”, Cốc Cốc browser is a product of Cốc Cốc company limited, which is created in Vietnam based on the foundation of open – source Chromium (Cốc Cốc browser here in after referred as to <strong>“Cốc Cốc”</strong>). Cốc Cốc provides you with products, software, services (<strong>“Services”</strong>) provided that you agree and comply the following terms of Terms of use (<strong>“Terms of use”</strong>)</p>
<h4>1. GENERAL REGULATION</h4>
<p>Terms of use stipulates obligations when you use Services of Cốc Cốc. Terms “You” and/or “User” hereinafter are used to refer to those who use Cốc Cốc’s Services. Please read carefully and save this Terms of use. By downloading the software and using our Services, You are agreeing with this Terms of Using. If You do not agree to be bound to this Terms of Use, You should stop using Services of Cốc Cốc.</p>
<p>You confirm and agree that there is no business connection, partnership, labor relations, or agency relationship between You and Cốc Cốc started by this Terms of Use or by using Cốc Cốc’s Services. We implement this Terms of use in accordance with the applicable law and there is no content in this Terms of Use to obstruct Cốc Cốc’s rights to comply with regulations or request of Government, court, enforcement agencies that are relevant to your use of Cốc Cốc’s service or information that we receive or collect from your use of Services.</p>
<h4>2. REFUSALS OF WARRANTIES</h4>
<p>The website and the Services of Cốc Cốc are provided based on non-warranty principle, on the basis of available services and features without any warranty in any forms regardless of being expressed or implied so. Cốc Cốc does not guarantee that our Services will meet your demand or guarantee that the operation of Cốc Cốc’s software or Services will not be interrupt or have any error.</p>
<p>Cốc Cốc does not take responsibility for any loss and benefit loss and other problems relevant to use of Cốc Cốc’s Services, including but not limited to the entire information, data, documents, music, sound, image, graphics, video, message or other materials (“Content”) that You can store, upload or transmit information through Services. You accept Services of Cốc Cốc with all of potential risks.</p>
<h4>3. MODIFICATION OF TERM OF USE</h4>
<p>Cốc Cốc reserves the right to modify and/or amend any terms of Terms of Use at any time without prior notice. Such modification and/or amendment will take effect at the time of being updated in website coccoc.com. If You continue to use Cốc Cốc’s Services after the modification and/or amendment is updated, You accept and agree with such modification and/or amendment.</p>
<h4>4. BANNED ACTIONS</h4>
<p>You shall use the Services of Cốc Cốc in accordance with currently Vietnamese Laws. Cốc Cốc will not ignore or allow any illegal or banned acts relevant to Cốc Cốc’s Services. The following is a number of illegal or banned acts when You use Cốc Cốc’s Services. We reserve the rights to investigate and take any necessary legal measures to anyone violating these terms, including but not limited to announcing to State administrative body, in accordance with decision-making authority of Cốc Cốc.</p>
<p><strong>4.1. You are not allowed to conduct actions including but not limited to taking advantages of internet for purposes to:</strong></p>
<ul>
<li>Oppose the Socialist Republic of Vietnam; damage national security, order, social safety, national sodality; propagandize invasion; cause feud, conflict, national discrimination, racism, religious discrimination;</li>
<li>Propagandize and rouse violence, obscene, social evils, depravity, superstition; harm fine traditions and customs of the country;</li>
<li>Reveal national secrets, military, security, economic, diplomatic secret, and other secrets regulated in the law;</li>
<li>Misinform, slander, offend the prestige of an organization; the honor, dignity of an individual citizen;</li>
<li>Take advantage of Internet to advertise, propagandize, sale products, Services that are blacklisted by the Law;</li>
<li>Violate intellectual property right;</li>
<li>Produce and circulate illegal technology products;</li>
<li>Create illegal link with domains of organizations, individuals who legally own and use them;</li>
<li>Disturb, damage equipment system and illegally prevent managing, supplying and using Internet Services and electronic information on the Internet;</li>
<li>Steal and use illegally passwords, security codes and other information of an organization and individual on the Internet;</li>
<li>Create and install harmful computer virus programs, software; commit an illegal action as according to the Information technology Law;</li>
</ul>
<p><strong>4.2. The following actions are considered as abusing Cốc Cốc and banned:</strong></p>
<ul>
<li>Announcing about Cốc Cốc browser under the name “Chrome” or other names irrelevant to the actual name of Cốc Cốc;</li>
<li>Paying the advertising revenues gained from clicks of Cốc Cốc’s users for any third party according to a cooperative program without allowing Cốc Cốc to participate in such program;</li>
<li>Locking Cốc Cốc browser or notice incorrectly that Cốc Cốc browser are not supported;</li>
<li>Preventing to download Cốc Cốc browser.</li>
</ul>
<h4>5. PROVISIONS ON USING CỐC CỐC’S SERVICES</h4>
<p>When using Cốc Cốc’s Services, You are bound to agree and comply the following terms:</p>
<ol style="list-style-type: lower-roman;">
<li>Cốc Cốc provides You the right to use Cốc Cốc browser and Services freely without copyright fee, franchising and monopoly. You shall not be allowed or allow others to copy, create derivative works or extract source code of Cốc Cốc browser.</li>
<li>Cốc Cốc browser which You are using may automatically download and install updates from time to time in order to fix bugs, improve, enhance and develop Cốc Cốc’s Services. Cốc Cốc browser can distribute its updates using peer to peer mechanism. You agree and allow Cốc Cốc using this mechanism for it’s updates as part of your use of the Services.</li>
<li>You agree and recognize that Content herein is personal responsibility of the owner of such Content. Cốc Cốc has right but responsibility to control, select, refuse, fix or change any available Content of Cốc Cốc’s Services. You have to take responsibility for taking risk when using Cốc Cốc’s Services, although Cốc Cốc use tools to select unsuitable or illegal information.</li>
<li>You agree that You have to take responsibility for your actions and any Content that You own, create, display or transmit when using our Services as well as consequence (if any) caused your use and Content. You agree that You only use our Services for lawful and appropriate purposes in accordance with terms of Cốc Cốc’s Terms of Use and Privacy Policy as well as other guidance or policy that we apply.</li>
<li>You agree that Cốc Cốc will not take responsibility for that your Content is deleted or not saved during the time we maintain and provide the Services.</li>
<li>You agree that You will not carry on business, use exploit, reproduce, copy, use Cốc Cốc’s Services for commercial purposes unless you obtain Cốc Cốc’s written approval.</li>
<li>You agree that Cốc Cốc provides a number of Services with advertising content and displays ads and promotions. You agree that Cốc Cốc has right to set such ads and promotions on Cốc Cốc’s Services and Cốc Cốc will not take responsibility for loss and damage that You suffer due to the display of ads and promotions or that You often receive such ads and promotions when using Cốc Cốc’s Services.</li>
<li>You agree that Cốc Cốc enables to link or provide links of other websites and You agree that Cốc Cốc neither controls nor takes responsibility for any Content, ads, service and product that You have or know from such websites. In addition, You agree that Cốc Cốc will not take responsibility for loss and damage that You suffer due to using the Contents, ads, services and products of such websites.</li>
<li>You agree that You will not participate in any activity or perform any action which may threaten to cause interruption or postponement of Cốc Cốc’s Services or services and nets linking to Cốc Cốc’s Services.</li>
<li>You agree that Cốc Cốc, with our full decision authority, enables to cease to provide Services to you in the event that Cốc Cốc reasonably believes that You violate or fail to fulfil the terms in this Terms of Use of Cốc Cốc.</li>
<li>You agree and accept that Cốc Cốc have right to decide to stop providing the Services at any time with or without notice. You agree that Cốc Cốc does not take responsibility to You or any third party since You are stopped to use Services.</li>
<li>Cốc Cốc reserves the right to scan the data from any public service you access through browser and use its public content to improve the quality of your browsing or the services you're using with Cốc Cốc.</li>
</ol>
<h4>6. LIMITATION OF RESPONSIBILITY </h4>
<p>You accept and agree that Cốc Cốc is willing to provide Services to you if You agree our limitation of responsibility to You and third parties. You agree that You take responsibility for compensating uniquely and fully for any complaint and/or claim to Cốc Cốc which is relevant to any violation of Term of Use caused by your termination of use of Cốc Cốc’s Services.</p>
<p>You agree to protect, compensate and hold harmless Cốc Cốc and its associate companies from any claim, suit, complaint, expense, loss, damage, judgment and litigation cost, including but not limited to attorneys’ fee, relating to or arising from the violation of Term of Use or Your use of Services, or any person using Services through You or Your computers. Cốc Cốc maintains the right, by its expense, to undertake fully to protect and control (without responsibility) such arising problems based on Your compensation.</p>
<h4>7. USER PRIVACY</h4>
<p>To understand clearly user privacy, please read Privacy Policy of Cốc Cốc at our website. This Policy will provide you with the mechanism of collecting, processing and protecting users’ information. When You install and use this browser, you agree to comply with the Privacy Policy of Cốc Cốc.</p>
<h4>8. PROTECTION OF COPYRIGHT AND OTHER RIGHTS</h4>
<p>8.1. Cốc Cốc’s Services and all of necessary software and component part of the Service, including intellectual property rights of Cốc Cốc’s Services, and all of necessary software and component part of the Service (“Intellectual Property”), are protected by copyright, trademark and logo rights, or other property rights owned by Cốc Cốc or owned by third parties that give Cốc Cốc the intellectual property rights. You do not have right to use any trade name and/or trademark of products and services, symbol, domain and other recognizing forms of products and services for commercial purposes unless You obtain written approval of Cốc Cốc, or if your use does not affect, prevent negatively to Cốc Cốc’s usual operation.</p>
<p>An editing activity (collecting, organizing and gathering) of all Intellectual properties of Services are exclusive property of Cốc Cốc and are protected by by Vietnamese Law and other international treaties on copyrights. Intellectual property of Services and other Services which are owned, operated, managed, by Cốc Cốc or given for Cốc Cốc is not for copying, reproducing, republishing, uploading, posting, or distributing in any form. Using or changing of Intellectual property of Cốc Cốc in any form, including but not limited to any website or environment linked to any computer without a written permission from Cốc Cốc will be an action of violation the Intellectual property right and other property rights of Cốc Cốc and will be prohibited by Cốc Cốc.</p>
<p>8.2. According to this term, Cốc Cốc respects and does not dispossess of your right of ownership or other rights to Content you send, publish online, transfer or display in our browser. You agree to be responsible for protection and implementation of such rights, and Cốc Cốc will not be responsible for implementation of such rights on your behalf unless there is an agreement between You and Cốc Cốc.</p>
<p>8.3. We respect Intellectual property right and request Cốc Cốc's users to do the same. You shall not be allowed to upload, tag, post, send or use any other available methods or any other components that affect negatively to copyright, trademark, trade secret or other property rights owned by organization and individual. We have right to stop providing the link to access the Services of Cốc Cốc or any other Services provided by Cốc Cốc to anyone we reasonably believe violates.</p>
<h4>9. OTHER TERMS</h4>
<strong>9.1. Applied Law</strong>
<p>This Term of Use amended by and are explained appropriately in accordance with Vietnamese Law. If there are any terms in this Terms of Service that are illegal, invalid or cannot be implemented for any reason, such terms will be considered removed from this Terms of Use and does not affect to the effect and execution of the remaining terms of Term of Use.</p>
<strong>9.2. Termination</strong>
<p>This Terms of Service will take effect until they are terminated by either You or Cốc Cốc under the following cases:</p>
<ol style="list-style-type: lower-roman;">
<li>Termination by You: You can terminate this Terms of Service by not using Services of Cốc Cốc.</li>
<li>Termination by Cốc Cốc: Terms of Service will be terminated immediately without prior notice if (i) as decided by Cốc Cốc if You do not comply any of the terms in this Terms of Service or (ii) Law or decision of Government, Court, enforcement bodies require Cốc Cốc to terminate the Terms of Service.</li>
</ol>
<p>After the termination, You shall delete all information, documents received from Cốc Cốc or other websites of Cốc Cốc, as well as copies or the information or document despite being created by regulations of this Terms of Service or of other regulations.</p>
