END-USER LICENSE AGREEMENT For Embrilliance Products
The Embrilliance software ("Software") is protected by copyright.
The Software is licensed, not sold.
All software and designs are Copyright, BriTon Leap, inc.
Embroidered goods created with the designs or fonts included in this product may be resold without permission.
You are granted a non-exclusive license to use the Software subject to the following important restrictions. By installing or otherwise using the Software, you agree to be bound by the following terms:
a. The Software may not be reproduced, transmitted or downloaded, except that you may make one copy of the original Software distribution media for backup and storage purposes.
b. Solely with respect to electronic documents created with the Software, you may make an unlimited number of copies (either in hardcopy or electronic form).
c. You may also store or install a copy of the Software on a storage device, such as a network server, used only to install or run the Software on your other computers over an internal network.
d. You will not decompile, reverse engineer, or create other software or products in any other medium based on the software.
e. All title and copyrights in and to the Software (including but not limited to any animations, audio, music, and text incorporated into the Software), the accompanying printed materials, and any copies of the Software are owned by BriTon Leap or its supplier(s).
f. The Software is Not for Resale. You may not resell, or otherwise transfer for value, the Software without permission.
g. You may not rent, lease, or lend the Software.
h. You may not transfer any of your rights under this agreement without permission.
i. Without prejudice to any other rights, BriTon Leap may terminate this Agreement if you fail to comply with the terms and conditions of this Agreement. In such event, you must destroy all copies of the Software and all of its component parts.
j. BriTon Leap and its supplier(s) do not warrant in any way that the Software will run on any particular operating system, hardware or platform, that it is free of viruses or harmful components, or that it will not damage your hardware, operating system or other software that you may be running. You are advised to take the appropriate precautions. Neither BriTon Leap nor its supplier(s) will be liable for any damages, including the loss of any profits, lost savings or disruptions that may occur as a result of your use of the Software. BriTon Leap's and/or its supplier's entire liability and your exclusive remedy shall be repair or replacement of the Software.
k. This warranty replaces all expressed or implied, and where lawful, statutory warranties, including any IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Some jurisdictions do not allow the exclusion of certain warranties as a result of which this limitation of liability may not apply to you in your jurisdiction.
l. You agree not to assert any claim against BriTon Leap or its supplier(s) in relation to your use of the Software.
m. This Agreement will be interpreted in accordance with the laws of the State of New Mexico, USA.
